GFMD Legalize Human Traficking

GFMD is a multilateral informal forum and multistakeholder process guided by state which is opened for 192 UN member states for identifying some practical method in strengthening relationship between migration and developments.

1st GFMD was held on July 2007 in Brussels, Belgian, while 2nd GFMD was on October 28/30, 2008 in Manila, Philippine. And the next GFMD event will be held on 2009 in Greece, then on 2010 in Argentina for the next GFMD.

Although the 2nd GFD chose theme" Protection and Empowerment Migrant For Development, but the attended delegations still have the same attention with the 1st forum: Formulating policy to develop relation between migration and development. This theme really gets more meaningless as the attended country delegations contributed mostly in migrant's right violence.

While at the same time, fundamental problem faced by migrants such as right protection without discrimination, with principles of sustainability, justice, humanity were fail to be paid attention in forum.

Attention to those problems getting more unclear when the forum more dominated by desire of participant countries to direct the discussion in optimizing migration as a tool to get free from today economic crisis by formulating a concept to enable remittance to be funding resources for development.

As recorded by World Bank 2007, remittance resulted by migrants from all corner of the world US$ 337 billion which is US$ 251 billion flow to developing countries. This among almost two-three of directs foreign investment (US$ 325 billion) and almost twice folds of official development aid US$ 104 received by developing countries.

It is publicly known that 80% to 90% of Indonesia Migrant Worker's problems come from government's policies. Those policies were part of paternalistic immigration policies ignoring the protection of Indonesia Migrant labor. In fact, policy such us regulation No 39/2004 About Placement And Protection Of Manpower Indonesia To Abroad never provide protection for Indonesia Migrant Labor , in contrary worsen the life of Indonesia Migrant Labor.

Those policies have negative impact for 6 million of Indonesia Migrant Labor, most of them women working in domestic sector as household worker. Generally, those migrant labors are in dirty, dangerous, and dehumanization condition.

Therefore, the attention of government on protection problem isn't more than jus a false promise. Even, without paying any attention to critique on unfair and exploitative act done by private agency. In contrary, even government created deregulation for easier permit access for private labor recruitment agency.

The policy combined with expansion of labor receiving country to achieve government's target of sending 1 Million with remittance Rp 125 billion per year. This target is over average sending of Indonesia Migrant Labor Rp 35 billion to Rp 44 billion per year.

SBY-JK Government also has an interest in GFMD event which was proved by the active involvement of Indonesia at both forum in Brussels and Manila. The involvement of Indonesia in GFMD is related to the effort to achieve "targets of development" as already mentioned above. Indeed, this attention isn't basic on desire to protect migrant labors but to get more economic advantage from the placement of Indonesia Migrant Labor.

Summary and Statement

Essentially, the discussion on GFMD was contrary to assertion and interest of public, particularly migrant labors and their families to be free from forced migration, debt slavery, forced over placement cost and unofficial levy as well as other form of force and other right violations.

After paying attention on direction and either on general or specific theme of GFMD, we summarize GFMD as a really forum legalizing human crime by strengthening the tendency of commoditization of migrant labor as well as legalizing human trading on behalf of development.

Basic on above review and attitude, we on behalf of Indonesia Manpower Association (ATKI), Legal Aid Institute (LBH)Jakarta, Institute For migrant Workers (IWORK), Woman Solidarity (SP) and Institute For National and Democratic Studies (INDIES), and Migrantcare state:

  1. Refuse all results of GFMD Assembly
  2. Refuse all forms of migrant labor commoditization, particularly experienced by Indonesia Migrant Labor.
  3. Assert Indonesia Government to ratify UN convention 1990 on the Protection of the Right of All Migrant Workers and Members of their Families.
  4. Support all initiations, assertions, and actions done by Indonesia Migrant Labor in frame of retaking, defending, and advancing right for welfare and social justice.
